Pragmatist reinterpretations of both deliberative‐communicative theory and legal positivism point out the mentalist fallacy entailed by these prevalent models. I argue that pragmatist approaches imply analogous erroneous beliefs since they presuppose as given the shared perception of social contexts. Therefore they take for granted the shared interpretation of social problems and shared selection of common goals. Hence I advance the necessity of inquiring into the possibility conditions for a shared perception of social contexts. This would entail the organization of institutional (...) incentives meant to extend the scope and inclusiveness of the immediate perception of social context expressed by different agents. (shrink)

John Dewey conceived democracy as a cooperative problem-solving practice in which actors try out provisional solutions by means of social communication. His notion of experimental democracy as a specific form of life and an ethical enterprise rather than simply a form of government implies the constitution of a polity as a practical and complex process of exchanging and sharing experiences. The aim of this paper is to test the feasibility of using a Deweyan theoretical basis for democracy to assess the (...) potential for a European process of political integration. The historical-conceptual presuppositions of the European Union’s institutional project preclude both a narrow local perspective and an illusory globalist scheme. Secondo i suoi più importanti biografi, il Nolano non ci sarebbe mai andato. Attraverso l’accurata analisi dei documenti relativi al corso di studi, e il riscontro delle citazioni contenute in alcune opere, l’ipotesi che Bruno abbia soggiornato ad Andria per circa un anno appare, invece, estremamente probabile. The article (...) tries to clarify one of the obscure points of Giordano Bruno’s biography. In 1571 the General Chapter of the Dominicans in Rome assigned him, as a formal student, to the Study of Andria. According to his most important biographers, the Nolan never went there. However, through the careful analysis of the documents relating to his course of studies, and the comparison of the quotations contained in some of his works, the hypothesis that Bruno stayed in Andria for about a year appears extremely probable. Abstract:We aim in this paper to explore several related challenges to contemporary analytical legal theorists who accept as theoretically foundational the state-based view of legality and legal system advanced by H.L.A. Hart. We contend that this approach contains internal explanatory problems which limit the view’s capacity to account for novel prima facie legal phenomena outside the typical experience of the law-state. We supplement the analytical approach by advancing the rudiments of what we call an ‘inter-institutional theory of legality,’ a theory (...) of legality derived from a morally-neutral, descriptive-explanatory picture of legal system qua system of legal institutions. Our theory additionally enables us to account for the novel prima facie legal phenomena we identify, and to conclude that while prior analytical legal theorists’ approaches to legality and legal system were historically right to depart from the example of the municipal legal system, that example and departure point are no longer most salient, so explanation of the legality within the state is no longer sufficient as a general explanation of legality.Resumen:En este artículo los autores se proponen explorar diversos retos que enfrentan los teóricos analíticos del derecho contemporáneos, los cuales han aceptado que una perspectiva estatista del sistema jurídico y de la legalidad —introducida por H. This article identifies and advocates one part of a renewed research agenda for analytical legal theory: a renewed ‘relational’ approach to characterization of the concept of law, following the lead set by Hart’s exploration of law’s relation to morality, coercion, and social rules. We advocate further descriptive-explanatory investigation of law’s relation to security, environment, and information technology, in the context of state and extra-state legal orders. This investigation is responsive to emerging legal phenomena as identified by the inter-institutional account of (...) legality developed in our recent book Legality’s Borders (Oxford University Press, 2010), and is further responsive to the interests and perspective of a modernized version of Hart’s ‘ordinary citizen.’ A renewed relational approach will provide a means to deeper characterization of the forms of legality arising within and around the increasingly unsteady municipal state in the modern era of increased interdependence and interconnection amongst state and extra-state legal orders.Resumen:El objetivo de este artículo es identificar y defender una parte de la renovada agenda de investigación de la teoría jurídica analítica: un renovado enfoque “relacional” sobre la manera de caracterizar el concepto de derecho —siguiendo la línea trazada por Hart de investigar la relación del derecho con la moral, la coerción y las reglas sociales—. Los sistemas argumentativos formalizan razonamiento de sentido común mediante la construcción, comparación y evaluación de argumentos a favor o en contra de ciertas afirmaciones. En tales sistemas existen dos nociones centrales: derrota y defensa. En el presente trabajo caracterizan ambas nociones y se discuten algunos desafíos para las caracterizaciones propuestas. Además, se realizan algunos comentarios al respecto.

Several criticisms exist surrounding the philosophical method of conceptual analysis in legal theory, but three have become particularly prominent in the last two decades. First, there are those who argue that the sheer diversity of types of law renders the pursuit of a single, overarching concept of law absurd. Second, there are those who suppose that engagement in con ceptual analysis cannot resolve boundary disputes about the concept of law, which was the very purpose of conceptual analysis in the first (...) place. And third, there are those who argue that conceptual analysis, as a general philosophical method, relies on a deeply flawed epistemology which has for a long time now been discredited. In this article I shall present each of these categories of challenges in turn (section I) before providing an assessment of their overall impact (sections II and III).Resumen:Existen varias críticas en cuanto al método de análisis conceptual en la teoría jurídica, pero tres de ellas han cobrado especial relevancia en las últimas dos décadas. Edith Stein no concibe la pedagogía sin tener en cuenta sus fundamentos antropológicos y éticos. Su anhelo por ver encarnada a la filosofía en su realidad personal la llevó a dedicarse fecundamente a la educación en el ámbito católico, del cual ya era parte activa. De la antropología integral de Edith Stein se desprende como consecuencia una pedagogía de la misma índole. Stein considera como misión de la educación llevar al hombre al desarrollo integral de las potencias del entendimiento, afecto (...) (Gemüt) y voluntad, fortaleciendo a cada una del modo en que le corresponde, sobre la base de una educación del cuerpo. Denomina «formación» (Bildung) al «proceso o trabajo mediante el cual la disposición anímica se configura en orden a una imagen formada», que debe realizarse en la naturaleza dada. Stein hace hincapié en que la educación se debe ejercer sin perder de vista que el ser humano, a medida que va madurando, despierta a la libertad espiritual para ganar autonomía; gracias a su libre voluntad puede él mismo trabajar en su formación, puede ejercer libremente sus fuerzas, puede abrirse a los influjos educativos o cerrarse a ellos. : Autonomous driving systems promise important changes for future of transport, primarily through the reduction of road accidents. However, ethical concerns, in particular, two central issues, will be key to their successful development. First, situations of risk that involve inevitable harm to passengers and/or bystanders, in which some individuals must be sacrificed for the benefit of others. Secondly, and identification responsible parties and liabilities in the event of an accident. Our work addresses the first of these ethical problems. We are (...) interested in investigating how humans respond to critical situations and what reactions they consider to be morally right or at least preferable to others. Our experimental approach relies on the trolley dilemma and knowledge gained from previous research on this. More specifically, our main purpose was to test the difference between what human drivers actually decide to do in an emergency situations whilst driving a realistic simulator and the moral choices they make when they pause to consider what they would do in the same situation and to better understand why these choices may differs. In an effort to produce new and more sustainable technologies, designers have turned to nature in search of inspiration and innovation. Biomimetic design (from the Greek bios, life, mimesis, imitation) is the conscious imitation of biological models to solve today's technical and ecological challenges. Nowadays numerous different approaches exist that take inspiration from nature as a model for design, such as biomimicry, biomimetics, bionics, permaculture, ecological engineering, etc. This variety of practices comes in turn with a wide range of different (...) promises, including sustainability, increased resilience, multi-functionality, and a lower degree of risk. How are we to make sense of this heterogeneous amalgam of existing practices and technologies, and of the numerous promises attached to them? We suggest that a typology of biomimetic approaches would provide a useful hermeneutic framework to understand the different tensions that pull this variegated landscape in different directions. This is achieved through a critical analysis of the literature in different fields of biomimetic design and the philosophy of biomimicry, in order to derive conceptual and normative assumptions concerning the meaning and value of the imitation of nature. These two dimensions are then intersected to derive an analytical grid composed of six different biomimetic types, which enable the classification of existing and possible biomimetic approaches, practices, and technologies according to their specific conceptual assumptions and guiding norms. This target article presents an integrated evolutionary model of the development of attachment and human reproductive strategies. It is argued that sex differences in attachment emerge in middle childhood, have adaptive significance in both children and adults, and are part of sex-specific life history strategies. Early psychosocial stress and insecure attachment act as cues of environmental risk, and tend to switch development towards reproductive strategies favoring current reproduction and higher mating effort. However, due to sex differences in life history trade-offs (...) between mating and parenting, insecure males tend to adopt avoidant strategies, whereas insecure females tend to adopt anxious/ambivalent strategies, which maximize investment from kin and mates. Females are expected to shift to avoidant patterns when environmental risk is more severe. Avoidant and ambivalent attachment patterns also have different adaptive values for boys and girls, in the context of same-sex competition in the peer group: in particular, the competitive and aggressive traits related to avoidant attachment can be favored as a status-seeking strategy for males. Finally, adrenarche is proposed as the endocrine mechanism underlying the reorganization of attachment in middle childhood, and the implications for the relationship between attachment and sexual development are explored. Sex differences in the development of attachment can be fruitfully integrated within the broader framework of adaptive plasticity in life history strategies, thus contributing to a coherent evolutionary theory of human development. This book discusses fundamental topics on contemporary Ockhamism. The collected essays show how contemporary Ockhamism can impact areas of research such as semantics, metaphysics and also the philosophy of science. In addition, the volume hosts one historian of Medieval philosophy who investigates the way in which William of Ockham “in flesh and bone” construed time and, more generally, future contingency. The essays explore the different meanings of this theory. They cover three main topics, in particular. The first examines the thesis (...) that sentences and propositions about the future have a definite truth value, without any ensuing commitment to determinism or fatalism. The second topic looks at the problem whether the branching-time model needs to countenance a privileged branch (the so-called Thin Red Line). Finally, the third topic considers the idea that there are so-called soft facts. These would be the subject matter of sentences and propositions verbally about the present or the past, but metaphysically about a later time, and which might change in the future. Overall, the book provides an updated and rigorous idea of the debate about Ockhamism. It gives readers a deeper understanding into this philosophical approach influenced by William of Ockham, characterized by the rejection of the Aristotelian idea that, in order to preserve the contingency of the future, future contingents must be deemed neither true nor false. The argument against innatism at the heart of Cognitive Gadgets is provocative but premature, and is vitiated by dichotomous thinking, interpretive double standards, and evidence cherry-picking. I illustrate my criticism by addressing the heritability of imitation and mindreading, the relevance of twin studies, and the meaning of cross-cultural differences in theory of mind development. Reaching an integrative understanding of genetic inheritance, plasticity, and learning is a formidable task that demands a more nuanced evolutionary approach.

Social research, from economics to demography and epidemiology, makes extensive use of statistical models in order to establish causal relations. The question arises as to what guarantees the causal interpretation of such models. In this paper we focus on econometrics and advance the view that causal models are ‘augmented’ statistical models that incorporate important causal information which contributes to their causal interpretation. The primary objective of this paper is to argue that causal claims are established on the basis of a (...) plurality of evidence. The logical hexagon (or hexagon of opposition) is a strange, yet beautiful, highly symmetrical mathematical figure, mysteriously intertwining fundamental logical and geometrical features. It was discovered more or less at the same time (i.e. around 1950), independently, by a few scholars. It is the successor of an equally strange (but mathematically less impressive) structure, the “logical square” (or “square of opposition”), of which it is a much more general and powerful “relative”. The discovery of the former did not raise interest, (...) neither among logicians, nor among philosophers of logic, whereas the latter played a very important theoretical role (both for logic and philosophy) for nearly two thousand years, before falling in disgrace in the first half of the twentieth century: it was, so to say, “sentenced to death” by the so-called analytical philosophers and logicians. Contrary to this, since 2004 a new, unexpected promising branch of mathematics (dealing with “oppositions”) has appeared, “oppositional geometry” (also called “n-opposition theory”, “NOT”), inside which the logical hexagon (as well as its predecessor, the logical square) is only one term of an infinite series of “logical bi-simplexes of dimension m”, itself just one term of the more general infinite series (of series) of the “logical poly-simplexes of dimension m”. In this paper we recall the main historical and the main theoretical elements of these neglected recent discoveries. After proposing some new results, among which the notion of “hybrid logical hexagon”, we show which strong reasons, inside oppositional geometry, make understand that the logical hexagon is in fact a very important and profound mathematical structure, destined to many future fruitful developments and probably bearer of a major epistemological paradigm change. Sleep and dreaming are important daily phenomena that are receiving growing attention from both the scientific and the philosophical communities. The increasingly popular predictive brain framework within cognitive science aims to give a full account of all aspects of cognition. The aim of this paper is to critically assess the theoretical advantages of Predictive Processing (PP, as proposed by Clark 2013, Clark 2016; and Hohwy 2013) in defining sleep and dreaming. After a brief introduction, we overview the state of the (...) art at the intersection between dream research and PP (with particular reference to Hobson and Friston 2012; Hobson et al. 2014). In the following sections we focus on two theoretically promising aspects of the research program. First, we consider the explanations of phenomenal consciousness during sleep (i.e. dreaming) and how it arises from the neural work of the brain. PP provides a good picture of the peculiarity of dreaming but it can’t fully address the problem of how consciousness comes to be in the first place. We propose that Integrated Information Theory (IIT) (Oizumi et al. 2014; Tononi et al. 2016) is a good candidate for this role and we will show its advantages and points of contact with PP. After introducing IIT, we deal with the evolutionary function of sleeping and dreaming. We illustrate that PP fits with contemporary researches on the important adaptive function of sleep and we discuss why IIT can account for sleep mentation (i.e. dreaming) in evolutionary terms (Albantakis et al. 2014). In the final section, we discuss two future avenues for dream research that can fruitfully adopt the perspective offered by PP: (a) the role of bodily predictions in the constitution of the sleeping brain activity and the dreaming experience, and (b) the precise role of the difference stages of sleep (REM (Rapid eye movement), NREM (Non-rapid eye movement) in the constitution and refinement of the predictive machinery. We investigate an extension of the formalism of interpreted systems by Halpern and colleagues to model the correct behaviour of agents. The semantical model allows for the representation and reasoning about states of correct and incorrect functioning behaviour of the agents, and of the system as a whole. We axiomatise this semantic class by mapping it into a suitable class of Kripke models. The resulting logic, KD45n i-j, is a stronger version of KD, the system often referred to as Standard (...) Deontic Logic. We extend this formal framework to include the standard epistemic notions defined on interpreted systems, and introduce a new doubly-indexed operator representing the knowledge that an agent would have if it operates under the assumption that a group of agents is functioning correctly. We discuss these issues both theoretically and in terms of applications, and present further directions of work. (shrink)

Whereas geometrical oppositions (logical squares and hexagons) have been so far investigated in many fields of modal logic (both abstract and applied), the oppositional geometrical side of “deontic logic” (the logic of “obligatory”, “forbidden”, “permitted”, . . .) has rather been neglected. Besides the classical “deontic square” (the deontic counterpart of Aristotle’s “logical square”), some interesting attempts have nevertheless been made to deepen the geometrical investigation of the deontic oppositions: Kalinowski (La logique des normes, PUF, Paris, 1972) has proposed a (...) “deontic hexagon” as being the geometrical representation of standard deontic logic, whereas Joerden (jointly with Hruschka, in Archiv für Rechtsund Sozialphilosophie 73:1, 1987), McNamara (Mind 105:419, 1996) and Wessels (Die gute Samariterin. Zur Struktur der Supererogation, Walter de Gruyter, Berlin, 2002) have proposed some new “deontic polygons” for dealing with conservative extensions of standard deontic logic internalising the concept of “supererogation”. Since 2004 a new formal science of the geometrical oppositions inside logic has appeared, that is “ n -opposition theory”, or “NOT”, which relies on the notion of “logical bi-simplex of dimension m ” ( m = n − 1). This theory has received a complete mathematical foundation in 2008, and since then several extensions. In this paper, by using it, we show that in standard deontic logic there are in fact many more oppositional deontic figures than Kalinowski’s unique “hexagon of norms” (more ones, and more complex ones, geometrically speaking: “deontic squares”, “deontic hexagons”, “deontic cubes”, . . ., “deontic tetraicosahedra”, . . .): the real geometry of the oppositions between deontic modalities is composed by the aforementioned structures (squares, hexagons, cubes, . . ., tetraicosahedra and hyper-tetraicosahedra), whose complete mathematical closure happens in fact to be a “deontic 5-dimensional hyper-tetraicosahedron” (an oppositional very regular solid). Trāṯaka is an interactive installation based on a brain-computer interface (BCI). Wearing this device, the user is invited to concentrate his attention on a flame placed in front of him, in order to extinguish the fire. This work is here presented as a case study about seamless interaction. According to the feedback provided by the users, Trāṯaka stimulates two main kinds of reactions: on the one side, scepticism, and, on the other, enthusiasm. In the first case, there is a clear (...) mistrust on the functioning of this technology. In the second case, there is a blind trust in the system that is perceived as magic. However, here, both these reactions are considered wrong. They share a basic and comprehensible misunderstanding of the system, because its interface aims to be invisible during the interaction. Interfaces that tend towards invisibility do not provide enough information about the system, alimenting misunderstandings and folk theories. In opposition, it is here discussed that design methodologies related to the ideas of Enactivism, Embodied Interaction and Material Engagement propose interaction strategies that involve the whole body-mind knowledge. Based on a gambling formulation of quantum mechanics, we derive a Gleason-type theorem that holds for any dimension n of a quantum system, and in particular for \. The theorem states that the only logically consistent probability assignments are exactly the ones that are definable as the trace of the product of a projector and a density matrix operator. In addition, we detail the reason why dispersion-free probabilities are actually not valid, or rational, probabilities for quantum mechanics, and hence should (...) be excluded from consideration. Some Carrollian posthumous manuscripts reveal, in addition to his famous ‘logical diagrams’, two mysterious ‘logical charts’. The first chart, a strange network making out of fourteen logical sentences a large 2D ‘triangle’ containing three smaller ones, has been shown equivalent—modulo the rediscovery of a fourth smaller triangle implicit in Carroll's global picture—to a 3D tetrahedron, the four triangular faces of which are the 3+1 Carrollian complex triangles. As it happens, such an until now very mysterious 3D logical shape—slightly deformed—has been (...) rediscovered, independently from Carroll and much later, by a logician , a mathematician and a linguist studying the geometry of the ‘opposition relations’, that is, the mathematical generalisations of the ‘logical square’. We show that inside what is called equivalently ‘n-opposition theory’, ‘oppositional geometry’ or ‘logical geometry’, Carroll's first chart corresponds exactly, duly reshap.. (shrink)
